Problems related to advocate registration.

The advocate act provides that no advocate can practice without registration.

There is nothing about punishment who practice without registration.

what is the remedy in such cases.

Bar Council or bar Association or the concerned court can lodge FIR against such person against various sections. Where there is no specific provision in special law, the provisions of general law prevail.

Even after registration in the bar as an advocate, they have to pass bar exam and after passing out the bar exam they can practice with the certificate issued by the BCI Chairman only.I am of the view that even without BCI or state BC they can be booked ubder 420 IPC.

Such unscrupulous persons should be brought to the book instantly and punished severely. One can present one's case as "in-persons" but cannot plead the case on behalf of someone else. Only advocates are allowed to do such practice. There are ethics of the profession; otherwise there will be law of jungle prevalent in the society!
