Hi,

I have a girl baby of 1.5 yrs, and my mohter inlaw is ready to transfer the property to her daughters child but not to my child and even she is not willing to share the property with my baby, and my husband is not ready to claim for this.
but my concern is my mother in law did not earn the property which she has in her name, but it was earned by father in law and now he is expired. so Can I put claim on this propery with my baby's name, can anyone of you helpme out here

Even though the property was purchased from your FIL's money, if the property stands in your MIL's name then it is her absolute property and you cannot stop her from gifting it to anyone of her choice.

If the property was in fathefr's name,in that case, after his death the property could not have devolved only in widow's name, but it should have been entered in the name of all sharers. But if the property was purchased in mother's name by her husband, then you have no chance.

The opinion of niranjna is perfect.

U said property was purchased by ur F-I-L. You have to prove that ur M-I-L had no independent income and she was housewife while purchasing the property. Burden lies on you.
Ur baby can claim share in the property thru., you as minor guardian.

Ur baby can claim the share in the share of ur husband.
