sir, we are a middle poor family living in bangalore since 40 years.. owner doen't have children or husband. she was gifted and regd a property by her brother in 70s.. some where in 1992 she gave us poa and we are living happily.. we got regd on poa some where in 2002 but she expired in 2000 we werenot knowing.. now her brother sons are well to do family and eyeing on this property.. we don't know what to do.. they are trying thru rowdies and other revenue officers with corruption.. we are under lot of stress and don't know what to do... poa was not registered since we are knowing the implications.. we are in position... we have little childrens and bed ridden father and age old mother... please help.. whether brother's sons still have rights since she doesn't have children.. please help... we are totally blank and cannot even imagine wihout house with small childrens and age old parents

More inputs are required like
1. From how many years you are residing in the house without rent ?
2. Do u possess ration card and electricity card in your name ?
3. You can file a suit for injunction to restrain others from troubling you and also file a suit for protecting your title.

What are the contents of POA?
Power of Attorney ceases the moment the executant is dead. The legal heirs of the executant comes into picture. What do you mean by power of attorney since you are a layman unless we know the contents of the said Power of Attorney we can not give you any advice.

TO GIVE YOU APPROPRIATE GUIDELINES AND ADVICE YOU SHALL HAVE TO VENTILATE THE CONTENTS OF POA FIRST. HOWEVER AS IT TRANSPIRES FROM YOUR SAY YOU ARE RESIDING IN THE PROPERTY IN QUESTION FOR MORE THAN 12 YEARS SO IN THE EYE OF LAW YOU ARE IN ADVERSE POSSESSION. IN VIEW OF SUCH A POSITION I ADVICE YOU TO TAKE HELP OF A SENIOR LAWYER IN YOUR LOCALITY.

As suggested by Malipeddi Jaggarao, the moments person die POA is not valid. Also it is not registered. Adverse possession is only hope to have lien over this property.

In Bangalore most of the people, to avoid payment of stamp duty and registration charges, just obtain a POA and take possession and start enjoying the property and do not worry/bother about the consequences that may arise at a later date. This is a wrong practice but unfortunately even now it prevails in Bangalore but as per law the author loses the right over the property especially in the event of death of the principal. Only way to settle the issue amicably is to arrive at a compromise with the legal heirs of the deceased title holder and atleast now register the sale deed in your favor to avoid any more such events in the future.
