Dear Sir,
My mother owns a house in Kurla,(Pagdi system) from last 27 years. We pay rent regularly.However the building is not in a livable condition and can collapse anytime during heavy monsoons.
We have asked the landlord to repair the building or redevelopment, but he denies doing so saying, there is a dispute among 8 brothers of landlord. Instead he has send us all a letter stating the building can collapse any time so request you all to vacate the premises and we will not be responsible if the building collapse.
I wanted to know what would be our (tenant's) stake when the building collapses. Will our rights in the property will remain or will be totally transferred to the landlord. What would be the further course of action.
It is a single storey building. Kindly help.

You can approach the rent controller and get an order for repairing the building at the cost of the landlord.

Please advise what would be our (tenant's) stake when the building collapses. Will our rights in the property will remain or will be totally transferred to the landlord.

your tenancy rights will remain . BMC has finalised a policy to protect interest of tenants . in case of redevlopment all tenants will have to be given alternative accommodation

I agree with the views expressed by expert Mr.Ajay Sethi. The government seems to have initiated steps to protect the rights of tenants through notifications issued there on.
