This query is : Resolved
Hi,
Me and my girlfriend are planning to get married legally and not by virtue
As we both reside from different religion (Hindu and Sikh-Punjabi) we have not got our parents consent to go ahead.
We both are eligible in age criteria i.e both are 26 years of age residing in India from birth and we are singles as of now.
My queries are listed below..
1) Which marriage Act will be considered for us if we go ahead with marriage
2) What are the conditions that it needs to be followed - Minimum Time / Cost / Documents
3) Procedure - In Simple words
Thanks a lot in Advance..!!

You can get married under Special Marriage Act or under the Hindu Marriage Act. However, it would be better if the marriage takes place with the blessings of the parents from both sides.

You can go with special marriage act. Consult a local lawyer, fees negotiable, other expenses not much (negligible as compared to legal fees of lawyer).

both are punjabis . it was common in PUnjab for mona punjabi to marry a sardar and vice versa . you dont belong to different religions . you can marry under special marriage act if you so desire .
Hindhu/Special marriage Application form duly signed by both husband and wife. 2. Hindhu/Special marriage Documentary evidence of date of birth of parties (Matriculation Certificate / Passport / Birth Certificate) Minimum age of both parties is 21 years at the time of registration under the Special Marriage Act. 3.Residential proof of husband and wife . 4.In case of Special Marriage Act, documentary evidence regarding stay in punjab of the parties for more than 30 days (ration card or report from the concerned SHO). 5. Hindhu marriage Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality. 6.Two Hidhu/Special marriage passport size photographs of both the parties and one marriage photograph.

sorry
"mona punjabi" is a disrespectful word for a clean shaven Punjabi.

Special Marriage Act is not needed here. In the eyes of law Hindu includes Sikh, Jain and Buddhist.
For cost and procedure contact either a Pandit or Granthi. Both are competent to perform this arraignment.

Dear Querist
File an application as intended to marriage before sub-registrar of your area where any one of the parties residing along with all the documents as Date of birth certificate as Pan card, Passport, High School Marksheet, 3-4 passport size photographs, ID proof, Address proof, Adhar Card.
after submitting all these documents before sub-registrar office, they provide a date after one month and affixed your intended application for marriage on notice board of the office. if there is no objections filed by any third party as parents of the parties, on the date fixed the sub-registrar may declare the solemnization of registered marriage and three witnesses will be required at that time and the sub-registrar will issue a marriage certificate to you.
for cost, there is no specific rules, you may take help of a lawyer for this and the cost will be fixed as per you and lawyer's negotiation.

Well advised by Mr.Ajay Sethi, Mr.Sudhir Kumar and Mr.Nadeem Qureshi which is confirmed by expert Mr.Rajkumar Makkad ji.
But....But, try to convince both the parents. You are not kids. You are of 26 years age. Take their blessings.
