rape case threat

Querist : Anonymous (Querist) 09 December 2010 This query is : Resolved 
a person got (safe) physical relation with his girlfriend. Now girlfriend is threating him for money and saying if he refuse then she will go to police and register FIR for rape against him. Is is possible that she got successful to register FIR for rape(the relation was safe and within 1 month with the consent of girl)

Nothing wrong FIR has been registered.Proceed with the case and you are advised hereby to convince her to settle the matter mutually,as the sexual act done with mutual understanding.

I think that she will not compromise as her intention is only to extort money from him. the boy is from reputed family so she is trying to black-mail him.

There is no time limitation for registering a FIR but delay sometimes becomes fatal for prosecution but in these kinds of cases like "RAPE" courts have shown lenient view on account of women modesty question. and if she registers FIR then court will presume that Rape has been done u/s 114-a evidence act so i advise you to approach a advocate for safety as after FIR yours arrest may be likely very very positive if she gets FIR registered. however case depends on the facts and that is the work of your lawyer.

She is blowing hot and cold. Let her go ahead with the allegations of rape and let the court give her a piece of its mind. Remember the Judgment of recent Delhi High court in allegation of Rape case. The female seduce and then alleged a case of rape.

Registration of FIR can be done, but under the circumstances, this will be a weak case.

agree with Mr. Chauhan and Mr. Arunagiri....but my friend why don't you try to trap her while she is trying to extort money,,,even audio-video means are admissible in evidence now....so ask her for a compromise and then trap her with all of her intentions....
