Refunding of paid amount by builder

I have booked a flat in bhopal and deposit total amount of 1,01,000/- to the builder.
Rs 51,000 as booking amount and 50,000 as first installment.The agreement was not signed yet.Due to financial problem I am unable to pay the rest amount to builder and want my paid amount back.Please suggest me what should i do to get my paid amount back from builder.Orally i have told him to refund back my paid amount.Builder is asking for an application with origional payment receipt but i refuses and provide him application with photocopy of payment receipt.He is just delaying for payment.kindly suggest me what to do.

what ever you do it should be written, otherwise you will lose,
first send legal notice with aforesaid fact to the builder, i thing he deduct some amount then give balance amount.

request the builder in writing to refund your advance payment . if he fails to do so move consumer forum for necessary reliefs

Without agreement you should not have paid first installment. See the conditions for asking for return of booking charges from the booklet given by builder calling for investors to buy.
Many an Experts have given you a course to follow.
