Regarding forged signatures

In a property case the defendant submitted a photocopy of Will by forging the signature of the testator. The Will is under challenge. Pl. advice me on the following points:-

1. What are the methods to identify the difference between original and forged signatures ?

2. Can after conducting scientific test it will establish the age of paper and ink produced by the defendant and claiming original Will ?

3. Name of the well reputed forensic test centre legally approved by the govt. of India.

4. Can forsensic test result differs from each other in such cases ?

5. What sort of action required to be adopted if a Will is found having forged signature of the testator and provision under different section of IPCs for punishment?

it is better to send the expert opinion. Photocopy of the will not be considered in the case, the other side has to produce the original will. If the original will is available then it can be sent for the xpert opinion.
You have to send the original will along with the other papers to show the signature of the testator for the opinion.

Criminal case can be initiated if the will founds forzed.

Supreme Court in several of its pronouncement has made it clear that will should be proof by the attestors as per section 63 of the Indian succession Act of 1925 and section 63 and 68 of the Indian evidence Act.

Prefer an application to the court saying that 'you want to seek handwriting experts opinion on the will' on it being allowed , and ur payment of requisite fees , the same will be sent to Forensic Lab Expert. In Pune it is sent to the CID , which has a branch. The report is then submitted directly in court.
