regarding transfer of property

Thank you Mr.B K Raghavendra Rao for your vaulable gulidlines, but some one adviced me that if there is no dispute between the legal heirs, there is no requirment to apply for sucesssion certificate so we didn't bother to apply for one. more over i heard that a good amount goes for stamp duty. i am toally confused.please advice.

Relationship between the legal heirs may be good today and you would not have any dispute. Tomorrow, who knows, situation may be different. Even if your relations are good, outsider vested interests may ill-advise your relations for the sake of their self-gain. Even if your relations do not dispute, their children may dispute. In my experience, I have seen so many cases where legal heirs are good now and turn bad tomorrow. In your own interest, it is better to obtain succession certificate.

Obtaining succession certificate is the recognised mode of transfer of property. It has to be followed if you have to have a pucca title. To save some money now, you should not loose your property tomorrow.
