Registration of unregistered document.

(Querist) 24 January 2010 This query is : Resolved 
Agreement to sale has been executed and possession has been transferred to the purchaser from seller. However, the document has not been registered. Stamp duty has been paid properly. Can this document be produced before the registration office for registration? What is the correct procedure? What will be the stamp duty and registration charges. Request for your kind advice. The deed of agreement for sale can definitely be presented for registration. The registration fee and stamp duty differs from state to state. So consult the Registration Act applicable in your state.

Where is the subject property situated?
When was the agreement executed?

Too many questions need to be answered by you before your query is answered:

1. Where the property is situated
2. What is the stamp duty paid
3. When was the agreement entered into and what is its validity up to.
4. Whether both the parties are willing to get it registered
5. Look into the Stamp Act applicable to your area and pay attention to the fact that 'possession has been handed over'. Normally the stamp duty would be full as applicable to the sale if possession is handed over.
