rental house

dear sir

right now i am in rental house for past 15 year but now the landlord want to vacate me out from that house i need sufficient time for that than how will i get stay order from court because my landlord want to reconstruct for commercial purpose what will i do please give idea to me

he try to take violent activities

so please tel how to face this in legally

Approach the civil court for injunction against unlawful eviction.

NO LAND LORD CAN EVICT A TENANT ADOPTING ILLEGAL WAY ,YOU HAVE RIGHT TO FILE A SUIT OF INJUNCTION PRAYING THE COURT TO ISSUE INJUNCTION AGAINST THE LAND LORD THAT HE BE PROHIBITED TO EVICT YOU WITHOUT ADOPTING DUE COURSE OF LAW,IT WILL PROVIDE YOU SUFFICIENT TIME TO MOVE.

As the fact is clear that you have been residing in the house for more than 20 years, the land lord cannot evict you force fully. Sufficient time has to be given for you to vacate. You can very much approach the court not to evict you force fully and seek the court to direct the land lord to follow the lawful eviction process by serving. In spite of his personal need of the property,he cannot evict you by illegal means.

And why bother , let the landlord file a suit for eviction against you in which he will surely fail.

Regarding threats file police complaints every time he creates a show.If there are more than one complaint at different occasions against the landlord , he will have to give surity for good behavior or otherwise he will be sent to jail.

All over even there are laws in favor of landlords but in practice all courts all over the world including all states of our country are in favor of tenants.

Do not get confused with recent SC judgments in favor if landlords, such judgments have come after years and years of rounds before various courts which some time takes more than life time.

AND AGAIN I WANT TO PUT STRESS ON THE POINT THAT SUCH JUDGMENTS ARE POSSIBLE BECAUSE OF BASIC FAILURE OF THE ADVOCATE OF THE TENANT FOR NOT TAKING PROPER DEFENSE AT INITIAL STAGES.
