Residential Permit

Dear Members,
can anybody please throw some light over the issue of residential permits given to foreign nationals.
where i can find notification/rules/regulations concerning the same?

Registration of Foreigners

Foreigners holding a visa for more than 180 days must get themselves registered, within two weeks of their arrival, at the Foreigners Regional Registration Office (FRRO) at Delhi / Mumbai/ Calcutta / Chennai. They are required to submit their papers in person.

Children up to 16 years are exempted from registration formalities. A Residential permit is issued to them if their stay exceeds 180 days.

No registration is required for a stay of less than 180 days. Pakistan nationals are required to register themselves within 24 hours of their arrival with the nearest police station.

Those holding a long-term multiple entry visa do not require ‘Intended Departure Clearance’ from the city office when leaving the country.

Accredited journalists are given the ‘Intended Departure Clearance’ at the airport.

Dear sir,firstly I am extremely thankful for your reply and information. its really appreciable from bottom of my heart.
but sir i was trying to look fr any regulation governing residential permits which are issued and valid even after the expiry of visa.
Sir, please if you can provide some information on that, it would be really helpful.

According to the Foreigners Act, the Central Govt has been given unrestricted powers in the matters of permissions to foreigners to remain in India or not. And under that Act, the Central Government has made orders called the Foreigners Order under which the FRO can permit a foreigner to stay in India after issuing Residential Permit duration of which is at the discretion of the FRO.

But sir, according to the provisions under various acts related to foreigners entry into India viz passport entry act, foreigners act etc, it came out that the avove proposition is true. Sir,there are case laws wherein the Higher Courts have justified the unlimited powers of the Central Govt in this regard and where the Govt ordered a foreigner to leave this country in spite of living here in india for last 20 yrs and was actively enagaged in charitable works. his appeal was rejected outrightly citing the SC ruling.

But for any notification other than the Foreigners Order, 1948, concerning residential permit, i was unabe to find anything. so I persumed that theres no other notification other than the said Order, 1948. Sir, if you come across any Notification concerning residential pemit, pease let me know since that would really be helpful.
