I had come across an advertisement published in a news paper 'Rajasthan Patrika'dated 9/12/09 in which is with the heading 'Dadi Ma Ke Nukse' under this techniques are given to kill new born girl child. So, I want to ask that under what provisions we can go against the newspaper and what remedies are available. I request you all please reply as soon as possible and also some SC judgments.

It is an offence under Sec 116 IPC read with 302 IPC and other relevant legislation in curbing the infanticide and crime against women. I think PIL against the Information And Broadcasting Ministry is appropriate way.

Section 116 of IPC is the only appropriate section which can be plied in the given facts. You can also make a strong representation to Press Council of India praying therein to derecognise such newspaper.

You are advised hereby report to the local police station with a copy of the news paper. Police will registered case against the news paper and also advertiser.If concerned police fialed to take appropriate action, you can file a writ at High Court for necessary directions to the concerned police station.
