reterenchment under UPID act vs Central ID Act for fix term

(Querist) 22 May 2009 This query is : Resolved
whether a fix term employee is entitled to get retrenchment compensation etc on the day of termination of service if he has completed more than one year of service
Guest (Expert) 22 May 2009
Fixed term employment falls within exception clause of S.2 (OO) of the I.D. Act, 1947 and hence, is not called retrenchment and hence, employer is not liable to pay compensation.

If in the name of fixed term appointment, the employer gives appointments from year to year on fixed term, for a number of years, retrenchment compensation has to be paid.
