Return of rent advance

I have given an amount as advance to a house owner to occupy his house as a tenant.He has also given the receipt to the paid amount.I have not entered into any agreement yet. Now the problem is that we cannot move into that house right now because of security problem.The locality is new and not developed still.In the night it looks insecure as there are no houses around except for only one in front.
I told the owner about my inability to move to that house and asked him to return back the advance amount.But he refusing to pay. I want to know what action can be taken to claim my money back. please tell the steps that can be taken.

File a civil suit for recovery of money.
Since it is a civil suit , criminal case would not be maintainable.

Serve upon to that person a legal notice and failing to get the desired results, file a civil suit thereafter for recovery.

how much is the amount? you will spend more money in litigation expenses and court fees if amount is nominal . catch hold of the broker through whom you had finalised the place . use his good offices to convince flat owner to refund your advance
