Revocation of gift deed under mohammadan law

(Querist) 30 August 2012 This query is : Resolved
Under Mohammadan Law whether a Gift Deed can be revoked, If yes how???
Whether without delievery of possession of gifted property the deed can be effected or not????
Plz help..........
Adv.R.P.Chugh (Expert) 30 August 2012
Without delivery of possession - the gift is an inchoate/incomplete gift.

Shia – Mere Declaration of Revocation is sufficient
Sunni – Revocation is possible only with the consent of donee or with intervention of court.
In Following situations Gift become irrevocable :-
i) Donor or Donee Dead;
ii) Donnee has introduced 3rd party interest;
iii) Donee related within prohibited degrees;
iv) Donor/donnee stand in marital relationship;
v) Subject matter of gift lost/destroyed
vi) Increased in value – and increment is inseperable;
vii) Hiba-bil-iwaz/Hiba shartul Iwaz – after payment of iwaz
viii) Sadaqah.
