Right to property

(Querist) 10 February 2013 This query is : Resolved 
My father died leaving no will. My mother has decided to give the property to one of my brother's. My another brother has shown objection regarding this along with me. What is my right as a daughter? How can i claim my share? Can i give a vakalatnama to my brother to jointly fight the case ? Please advice

you are not mentioned above said property whether it is ancestral property or self earned property by your father, if ancestral property all the legal heirs have rights to equal, if self earned without any will its also equal shares.

The mother has the discretion only if it is her self earned property.

you have a right in the property . You can jointly fight the case along with your brother and claim your share through the court by way of partition.
