Roof projection and sun shade related related

Hi,

I would like to inform you that I have started construction for my home recently.

I have purchased a plot in Divya Rock Island in Indore ,MP which is located in Sanwer district in Panchderia village.

My plot size is 760 sq feet (37.5*20)

I have constructed the foundation of my building and left 1.5 metres distance from the concrete road on both side of the building as the plot is at the corner.

Previously my building line was 4 feet 7 inches from the road but the colonizer raised objection and forced me to move my foundation 1.5 metres on both side. I have bent the column 4 inches and constructed the walls as demanded, but they also informed me not to extend the roof or build any sun shade for the windows as well. Now my query is that if there is no sunshade in my windows or any projections in the roof, then rain can easily drain inside my house, My roof is 12 feet above the ground so is there any harm if projections of at least 2 feet made in the roof. Still 3 feet distance will remain from the road.


For your information drainage line has been already laid. Water supply and electricity lines are yet to be done.

As I am staying on rent, I want to complete my house as soon as possible and I will arrange water supply and electricity of my own.

My plot is registered on my name and permission formalities are all done, there are no dues for payment on my part.

So therefore please, kindly suggest what should I do now.

If the structure is within approved boundaries then why the objection.

Whether the map was approved by the Municipality or the approval of colonizer is required for getting the map approved by Municipality?

What is the position of other houses, whether these are constructing projections like you?

Whether colony is approved, if so what pattern of construction is approved by government?

Can discuss with local draftsman.

They are having objections for roof hanging or extensions in the roof,i.e I mean to say that My foundation or building line is 5 feet from the road but if I construct sun shade or extend my roof at least 2 feet then the distance between the road and roof top will not remain 5 feet. So is it mandatory that the roof of any building or house should be at least 5 feet from the road.

They are not allowing me to construct any part of my building with a distance less than 1.5 meter of 5 Feet from the road.So though the height of my roof is 12 feet from the ground, is it mandatory to maintain 1.5 metre distance from the road even at that height.

Height is no defence to extending in to the common / road area. One should get along with normal parlance of other members of the colony as also municipal rules.

You are yet to confirm whether the lay out as well your plan for construction has the approval of the local body.

Has other habit-ants also built like you?


Does builder want any payment to allow?


Does MC ask for say; compounding?

The plan is approved by the Municipality. I am the first one to build the house as after so many commitments by the colonizer water and electricity is still not provided.So the other plot owners are still waiting for the facilities yet to be provided. I have already waited 1 year after my registration of the plot.

Any projection, like Sun shades etc. is not allowed over and above the allotted measurement of plot, unless the competent authority of the local body allows that in the layout plan, if permissible in building byelaws of the local body.

Any structure, like Sun shades, if extends beyond the approved measurement of the plot cannot be said to be within approved boundaries

You have not responded to:

"If the structure is within approved boundaries then why the objection?"


Here in a simple layman's language; boundaries are your plot purchased by you minus green belt if any.


In many locations NO construction/covering is allowed in green belt.



Another Perspective: Check with local authority under whose jurisdiction property/colony falls e.g; MC................and does it allow shades etc outside boundaries and has it kept any distance of shes etc or outer wall from road/gali.


And also whether the colonizer has submitted map of colony with roads and development charges and any other fee to authority?

You can not construct away than the sanctioned plan.

you could have availed the opportunity to extend projections if precedent is there.

For electricity and water send notice to builder and later file consumer complaint.

Yes.


Even if colonizer sy that there are No inhabitants still you may get a handle.

Why can't you handle the colonizer if you are right.


Assuming that you are wrong, what worst is being feared::: demolition of shades, fine !
