ROUTE PERMIT

Sir,
I would like to know the effect of the case/claim under 166 M.V.Act where the vehicle causing the accident though having a valid Insurance, the Route Permit does not stand in the name of the Insured(O.P.No.1 in the case) but stands in the name of the previous owner of the vehicle. In such a case, what would be the Insurer's liability, if any, towards the Third-Party/claimants !!

Insurance company cannot be exonerated from its liability to compensate because no such term generally become part of contract between insurer and insured and even if such term exists therein it is against natural justice and in that case also insurance company is liable.

Well, I am in doubt abt the effect of the provisions laid u/s 82(1) of M.V.Act in relation to Insurer's liability under these facts & circumstances. Would u pls explain.
