Dear Sirs,

I had made RTI to District Co-operative Bank seeking some information. I have got reply that District Co-operative Bank is not covered under RTI Act.

Kindly advise as to what is the remedy in this case. How can I get the information?

The Bank is under the Control of the Govt. of India and is squarely covered under the RTI Act.

Prefer an appeal against the orders.

There are sufficient judgments available in this regard.

If the Bank is claiming that they are not covered under the RTI act then they must not have appointed any appellate authority as well. In this eventuality better approach the CIC as there is a violation of provisions of S.4 of RTI act also on the part of Bank.

If you demand information about a person against which he has liberty to refuse the bank can deny to provide information such as accounts details etc. otherwise bank is covered and you should prefer an appeal against their order.

File an appeal against the same or approach CIC since the District Coop bank in this case will not be having an appellate body.

I am adding one more thing there, if the Bank is under the control of State Govt. then you will be required to approach SIC instead.
