Sir,
Whether information can be asked about the property of private unaided school. If not please suggest some case law.

arvind in what context u need the information.

if only the private interest is involved then u can not.

if the document is public in nature or there is some legal violation then certainly u can ask for the info from the govt. and in no case directly from the private unaided school.

As a private unaided school do not get grant from State so it does not come within perview of RTI Act and so any information can be asked from it under the provisions of this act.

If it is for private intrest then you can not ask.

Sir "A" has constructed the garage in a plot adjacent to unaided private school. School authorities objected. Because the school authorities have complained of 'A's action to govt, as it was encroachment on govt. land. In revenge and with malafide intention "A" has applied to Tehsildar (Information Officer), for the details of land of school. Tehasildar is inquiring the details of land record of school in pursuance of "A" application. School is ready to submit the land records. But whether "A" has such right. Is there any clear cut provision or case law in this regard?

A can ask the information from the authority which has granted the land to the school.

A has definitely got right to obtain information from the office of Tehsildar office about the status of the land record of the school. The information has not been sought from the school rather from the office of Tehsildar. Application is maintainable.

yes A can seek such an information.

the land document is a public document so no restriction on asking for the info from the public authority.

Sir don't you think that it is a third party information under Sec 8(1)(d) of RTI Act. "A" has not donated the land but the Donner is some one else.
