Before hiring an Advocate,can I file an RTI
{through someone else,of course} to check how much successful my would be Advocate is in the past,how many wins,how many losses,how many compromises--he has scored ????

Amita ji and Parthasarthi Ji,if there is no provision of putting RTI as I have proposed then use please Ur imagination and suggest some ways to make it feasible,Bar Council can be invited,included--I propose...

most of the time,only a trial and error style works with regards to choosing an advocate,especially for a common man.
I feel,there is nothing funny in the question,if we take it in right spirit.

As I am orchestrating this idea time and again. BCI should initiate steps to make online profile all its members in its website. Web enabled technology can enable anybody to have an access to the Bio Data and Skill sets of an advocate for the clients to choose from. DOB, Qualifications, Enrollment date, Cases contested, track record, etc can be made transparent for every Registered login users to view and choose his counsel. This would make the profession more competitive and qualitative. Hope this would address the needs of the querist.

in present circumstances I do believe it to be a funny question rather a ridiculous too.
but on logic I agree with Mr Loganthan also but to some extent.
the no. of cases contested and won can not be criteria for choosing a good lawyer. whosoever lies in the court has to loose the matter.
the other aspects like area of specialisation, experience etc. can be posted.
but my dear friends, its futile discussion, every one knows who are at the helm of the affairs. nothing is going to change, you must observe the authorities have not been able to improve the legal education. the other issues are distant dreams.

Kiran Ji,for the litigants who wanna win only ,it is a criteria to chose an advocate,who is generally winning certain kind of cases,say eviction cases or cheque bouncing etc.etc.,but for those who know that they do not have solid grounds for winning,they may chose Advocates who succeed in some other fields ,like getting adjournments and ultimately bringing the righteous litigant to the knees for an unethical settlement etc. etc.
Kiran Ji,my dear friend,what can be dreamt,can be realized also ,one day,I assert.

RTI Act 2005 is applicable to public authorities only.
Please read clause (h) of section 2 of RTI Act 2005;
"public authority" means any authority or body or institution of self-government established or constituted-
(a) by or under the Constitution
(b) by any other law made by Parliament
(c) by any other law made by State Legislature;
(d) by notification issued or order made by the appropriate Government-......
In general view Advocates are not a public authority.
But, my personal opinion is that; since they are registered with BCI so they comes under sub-clause (a) of clause (h) of section 2 of this act.
We will now start its examination. Thanks to you for bringing our attention to it.
Suggestions;
1. Track record should be available and in transparent manner like on internet site of BCI.
2. It should be mandatory for validity of registration in BCI to submit periodical track record with details as needed by Mr. Tushar including progress of each case such as dates attended.
3. It should be mandatory to submit a copy of every Vakalatnama to BCI.
4. As a paid service Advocy should also be responsible & accountable and there should be a forum of BCI like "Consumer Forum".
More suggestions please. It is going to be a revolution initiated by TUSHARCOMIC and DRF will be with him for this move.

Above all, every advocate must be made accountable for all professional flaws and misconduct detrimental to the nobleness in order to set high standards in the society.
