We have a shop jointly owned by my mother and father, my mother being the 1st holder & my father being the 2nd holder my father expired without doing nomination and making will, my mother is still alive, we are 3 childrens can we sell our shop without succession or heirship certificate

In that case, your mother and you three children becomes the 1/4 share of the half of the property left by your father.

You can obtain legal heir certificate and get the property mutated in records in the name of all.
