Second illegal wife rights and his son right

My father was expired on NOV. 2003 .
We are two brother and my elder brother is also expired on mar-2012.
My mother and i alive .
my brother was marriage with 2 women ,
second married without divors to first one .
One wife not married with any body and no children.
second illegal wife has one son.
My father left only one residential house.
Pl. advice me, what is the rights of second wife and her son in this house.

Mr Goyal,
As per your case is considered I should clarify it that without divorce second marriage is not valid in the eyes of law . so legally on that ground the second wife cant be move forward.

If second wife not want to stay with us , but expecting lum sum amount for leave house then what is the correct solution ?

she has no right against your brother. only the child has the legal right. legally you are not bound to pay any compensation but if you mutually agree and do not want any disturbance than you can settle down giving something appropriate.
