Selling the property

I am having one land which is in ranjangaon village.land is on my dads name.My dad is no more.i have constructed rcc building which is residential on that land.I and my brother have contributed the same.By mutual understanding we have decided to sell the property.The plot is not NA.How can I sell the residential part and what are the documents needed for selling the flats..Can the buyer make loan for purchasing the flat..

First apply Legal Heir certificate in Revenue Dept or Tehsildar Office.Consult A Local good Senior Advocate to make sure all the documents are in tact like EC etc

The documents related to the property need to be seen.
Few things should be clarified such as:
Whether the plan of the building is sanctioned?
What is the FSI used?
As you have mentioned you are willing to sell the residential part, does that mean you also have commercial portion of the construction?
Who has the title of the property currently?

I agree with the details sought by Mr.Yogen Kakade. I would like to add that if no restriction for property registration for unapproved properties in your area and buyer is willing to buy you can do after ensuring transfer of property in your names in the revenue records.

In addition to the questions raised by experts Mr. Yogen Kakade and Mr. Krishna Mohan, which I fully agree, you are required to disclose whether the land/plot is the self-acquired or ancestral property of your deceased father?

Whether your father had died intestate or executed any deed/document?

Whether Ranjangaon village is situated in rural area or urban area and located in which state?

Whether any plan was required to be approved by local/state department of Town Planning?

Whether land-use has been changed by concerned authorities?

Discuss with a local prudent lawyer with relevant documents of the property.

Did you act to transfer the ownership by inheritance in records of authority under whose jurisdiction property falls?


Was it transferred it in the names of legal heirs?
