Senior citizen reglar case hearing/allocation in high courts

(Querist) 20 November 2012 This query is : Resolved
Hi sir

In one of the eviction cases in high court We forgot to submit application for senior citizen and as off date the case has been dating for 1 year now. Earlier in lower courts we have won 2 times and the dates were also small less than 2-3 months.

I require guidance on three points.

1. If we are respondents in civil revison case and the case pertains to senior citizen can we still file application of senior citizen case manamgment.

2. If the above is yes than where to submit application for regular case allocation as senior citizen and who can file application can we pesonally file or through mr advocate.

3. As off now we have been awarded a next hearing date in high court, would the long date be changed by filling senior citizen application.

Please guide.

1. Yes
2. No need for filing application. A SIMPLE MENTIONING BEFORE THE BENCH WOULD DO.

3.Yes after giving due notice to the advocate of the other side.

Apply in writing to court to expedite matter on Sr Citizen Grd. . It will remain on Court Record, with Order of Court, so matter will move fast.

Good day experts

Thank you very much for the valuable advises.

Kindly shower more guidance.

1.Can we personally go and file Sr Citizen Grd. application or the same needs to be done through Mr.advocate.

2.How much time it should take to get the case routed and solved in High courts where as I have read that civil revisions / evictions should take not more than 1-1.5 yrs is this fact true or some other process is taken.

Also are civil evictions cases put in fast track courts .

Please help.
