sir, We had one shop which is under a joint name of my mother & father. Mother is the 1st holder & Father is 2nd holder but now father has been expired as my father has made no will what so ever nor he has made a nominee and our society has not been registered... as we are three children so if we want to sale our shop in future so in that case what we have to do our shop is at Thane Maharashtra

You all need to get succession certificate from civil court so that you may be declared true owners to the mentioned property.

Yes you can do so but not without the consent of your mother.

After getting succession certificate, along with your mother, you will be able to sell shop.

how succession certifacte is made & what r the charges for it as our shop cost is Rs. 4000000/- (40 lacs), does succesion certificate is to be made compulsory?

Yes, succession certificate is mandatory. Hire local advocate, he will do needful for you.
