Stamp duty refund

(Querist) 04 March 2016 This query is : Resolved 
One Mortgage Deed completely is executed between Bank and individual. Stamp Duty and registration fees also paid through E-challan.

Then individual decided to not to take loan and he want his stamp duty refund.

Can he get stamp duty refund on executed Mortgage Deed by both parties?

Note:- The said Mortgage Deed Executed between bank and individual in Mumbai.

You (mortgagor) have to apply for refund to the RDO concerned stating that the transaction is cancelled with copy of E-Challan.

Whether the mortgage deed registered?

After execution of the document, stamp duty is hard to refund.

I agree with expert Mr. Rajendra K Goyal; once the deed is already executed and registered therefore, neither stamp duty nor registeration fees can be refunded.
