State election commission

(Querist) 04 May 2017 This query is : Resolved
Even though state election commission is an statutory body, do they not need to obtain approval of government for entering into contracts?
Sudhir Kumar, Advocate (Expert) 05 May 2017
How can you assume this forum to be spokesperson of all 36 SECs.
chunu subba (Querist) 05 May 2017
It's not a matter of assumption. The point of reference is can they enter into agreements without approval of the government? Can they function independently in agreement cases? Regarding election they have powers but to enter into agreement I want to know.
R.K Nanda (Expert) 05 May 2017
state real facts, if any.
chunu subba (Querist) 05 May 2017
What I have stated is the fact.
Sudhir Kumar, Advocate (Expert) 05 May 2017
what is the problem you are facing?

why cannot you have information under RTI from concerned govt body?

How do you feel that this forum will speak on bahalf of these commissions as to what they do in matters not at all concerned with law.

Academic query.

State material facts of the problem if any.

How are you concerned / related with the query?

Looks like examination question.
chunu subba (Querist) 05 May 2017
In whatever way I am concerned , the question is simple and to the point. I have quoted the specific point for which no one has answer. Sad

Agree with experts.
Sudhir Kumar, Advocate (Expert) 06 May 2017
There is no specific point you quoted from legal perspective.

The query is purely on the procedure followed by SECs which are 36 in number. You have not quoted any specific instance of any suspected violation of law and the problem faced by you.

The query appears to be a question set in the departmental promotion examination of the audit deptt.

The query is not at all legal.

This forum has solved lakhs of legal query but cannot solve riddles.

Consult your tutor and close this thread.

Prima facie there is no legal dispute involved in given circumstances of the question paper.

1. All "election commissions" (without any exceptions) are "autonomous bodies" (like RBI .... ) and works independently without any directions or interferences from the Govt dept.

Please Refer the Guide Lines mentioned in Model Code of Conduct to be followed during the time of Election. It clearly states that Government has to take Permission from Election Commission for any tender or any other activity mentioned in the Guide lines during the Time of Election. So No approval is required from any one to Election Commission.
