Subpeona to MD of the company. Accused is the MD.

Private complaint against the only accused Mr.X u/s 406,409 of IPC.

Managing director of a company is called for as Witness by court subpoena. Incidentally Mr.X is the managing director.

The accused says it is a subpoena to the accused and claims illegal.

My argument is that Managing director and Mr.X are different legal entities, and I claimed that the managing director can authorize any of his office bearer to give evidence.

My learned friends may give their valuable opinions on my stand.
Is there any suitable case law.
