Succession rights to the daughters

(Querist) 08 December 2011 This query is : Resolved
Dear Sir/Madam,

My mother's father died in 1993 without making any will and left some property. He is having 2 girls & 3 sons. The 7/12 is now jointly on the name of 5 childrens. Since last 3 years 7/12 is unpaid. There are some tenants who are paying the rent to 2 brother's and from which the proeprty is getting maintained. Now two brother's are denying to give the equal rights to two girls. We have tried to solve this mutually and also shown the recent supreme court judgement. Even though the same is denied.
Now can we go for legal and what steps we have to consider while filing a suit.
Your expert advise is highly appreciable.

Thanks

Swapnil

You can file a civil suit for partition and possession on the basis of 7/12 extracts and mutation of your mother's father.
