Whether, one of the legal heir can cliam sucession certificate on behalf of all other sucessor ? In case he required to get transfered the share certified registered in the name of deceased....

Succession Certificate has to be applied for by all the successors. However, one of the legal heirs may get power of attorney to act on behalf of all others in the suit for succession certificate like leading evidence, facing cross examination, if any, etc. Succession Certificate has to be issued by a competent civil court for which there shall a judicial proceedings.

One of the legal heir can file petition seeking succession certificate impleading all other legal heirs as respondents and there is no hurdle in this process.
