(Querist) 25 August 2008 This query is : Resolved
Is there any Rent Controll Acts in any State in India, which says that Tennant shall also include Paying Guest?
Kiran Kumar (Expert) 26 August 2008
Every respective state has its own Rent Controll Act or Law.

Tenants do not include Paying Guests, in my opinion.

but u ve raised a good query, ill check it from Punjab and Haryana Laws.

Dear Respected Members,
in my opinion paying guests does not come under the purview of Tenants since Mah. Rent Control act does not include paying guest as a tenant. Some other satate laws could be different on this and we need to go out in the respective state's rent laws.

In a tenancy the possession of premises passes to the tenant but in case of Paying guest the possession remains with the owner. Therefore a paying guest can not be tenant. My Ld. friend Kiran is checking up whether any state has specifically included paying guest in the definition of tenant.

PAYING GUEST CANT BE A TENANT UNDER THE RENT LAWS.ITS NOT MERELY POSSESSION BUT RELATIONSHIP WHICH MATTERS.TOMARROW GUESTS IN HOTEL WILL ALSO SAY THAT THEY ARE TENANT.THERE IS DIFFERENCE BETWEEN LEASE AND LICENCE.
