Tenanted property tr to ltd co

(Querist) 28 October 2012 This query is : Resolved 
A nursing home given on Rent was converted to Pvt Ltd Co without the consent of the Landlord. The 1st Tenant expired and his wife took over and after 4 years she sold the property to her relative without the agreement or stamp duty payment .This new tenant converted the property into Pvt Ltd Co and transferred the shares to other party again without the consent of Landlord. A suit was filed and consent terms were taken after 2 years due to severe external pressure from the tenent.In consent terms the tenant was barred from carrying out any illegal additions/alteration to the premises ,however the tenant carried out extensive work without the consent of Landlord and permission from B M C. A suit has been filed again for violation of consent terms please give opinion

Any structural change and subtenancy without the consent of landlord gives rise to cause of action for eviction of tenant.
Landlord should have long ago filed such case for eviction.

tenant is liable to be evicted . no structural alterations cna be carried on without consent of landlord
