Hi,
I am living in NZ, and a member of This Lawyers club of India. Came across with an expert lawyer from this site regarding property Relinquish deed. From NZ, I delivered Rs 50,000 on his demand for the work to carry out. He delayed. Finally, I came to India after few weeks, completed the work through him with a payment of another Rs 1,24,000 to him through bank (partly to his a/c and his son's) He did not account for a lakh of the amount paid. I came back to NZ. Now he is avoiding my phones/emails.
I alerted his son, but no use.
Advice what to do?

he has done your work . he executed deed of relinquishment as you desired . got it stamped and registered . you agreed to his fees . you willingly paid the said amount as his charges

Generally Lawyers all over India refuse to provide receipts against their agreed fee just for avoiding payment of taxation.
There is no use to waste your further money on telephones. Stop it as no receipt is going to be handed over to you by that lawyer.

Are these professional a blot on the profession. Cann't we do some thing to rein such nuisances. Let us make a beginging by pledging that we shall not receive any fee without issuing a proper serially numbered receipt and shall account for it for the purpose of taxation. We should not encourage people to evade tax when there is enough room to avoid it. Tax avoidance by a better tax planning is duly recognised by the courts as a device within four corner of laws. Being professional we should use these tools, then to indulge in illegal means.
Hope All Xperts agree with me and would start a compaign in guiding Senior and junior colleagues in the profession.

Hi,
Mr Rajoo: Yes all amounts were paid through recorded transactions. He accepted the receipt of the total amount through his email.
Hi Mr Ajay Sethi and Mr Raj kumar Makkad: I am not asking about his fees.
He claimed Rs 36,125 against the registration and Rs 1,08,375 against Stamp Duty. Whereas on the Relinquish deed it is showing Rs 1,000 and Rs 55,000.respectively.
What happend to the balance amount of Rs around a Lakh which he claimed for the subject purpose---Please advice further.

The reactions of LD experts are without knowing the other side.
Payments may have been made to the system and every other thing may have agreed but now problem after work is over.
WE DO NOT KNOW THE REAL STORY.
Any way without hearing the other side all inputs are injustice.

Yes Mr JSDN,, Do you think the so called payments to the system run to a lakh?
I agreed and paid in advance my lawyer Rs 10,000 as his fees which he never expected. But he claimed Rs 16,000 at the end without my consent.I Accepted, though it was high side and work was not up to the mark. May be 3-5 thousands go to the system. Never mind.
Let him tell The REAL STORY at least to his own client.And am prepared to accept any type of expenditure. My query is where he spent if not 'on registration and stamp duty' as he claimed. He is one of the recipients of this query. I purposefully posted to him too along with all other advocate experts.It seems he Kept watching all your reactions silently.

First of all I am not that person.
If I would have been that person I would not have settled for such meagre fees , knowing before hand such professional hazards.

I said he has not replied (in my earlier post). That tells it was not you,and all the other experts responded to my query so far.
Thanks to all of you.
He is watching for the last 24hrs.Did not respond. I am going to disclose him after 24hrs. (Allowing, he will resolve the issue before that, with out costing his reputation).

although registration fees offically may be rs 1,000 out of pocket expenses for registration are high
the difernce of rs 1 lakh has to be explained by advocatwe whom you have breifed .

The point of contention is not the Fees.It is the amount he claimed spent on Regn and Stamp Duty.Which should have challans or on the back side of the DEED. He could not produce the challans. I could not find the claimed amount on the DEED.

Dear Mr.Mohan,
You have proceeded only after consulting the expert about the work and the expenses involved.How much money he has asked or how much money you have paid is between both of you only.There is no use putting it in this forum.It was your personal work. Framing charges against the lawyer is baseless now, after your work is done.All the experts have given different kind of replies.One lawyer may charge 1000 for a particular case and another lawyer may charge 10000 for the same case.It always varies.

Please note, my intension is not to tarnish his image, or 'audit' the amount. I want to get the truth, not the money. When I trusted him, and given a free hand to do a job, instead of getting relief, he himself become additional work to me. I want all to apply pressure by pouring the comments, then surely he will come out with the truth. Please get back the lost public confidence in the legal system. THANK YOU.
