Transfer of Property

I just wanted to know about the NOC, that is used to express the no objection of one party relating to the transfer of the property to another party. I wanted to know what is NOC, whether it can be typed on a plain paper, or on a stamp paper, or if there is a prescribed form relating to NOC.

Dear Anonymous,NOC means No Objection Certificate.In general practice, In case of transfer of the property it can be typed or written in the shape of affidavit on the stamp paper.As required by law it can be typed on plain paper also.In my knowledge there is no prescribed form.It can be written or can be created according to need.

Mr! As per my knowledge, mere NOC from any of the party is not sufficient for the transfer of property in favour of any other party until and unless it meets the other requirements. There is even no application of NOC rather if any party wants to accept the claim of some other party, it has to make specific statement in writing before the particular authority/court.

Otherwise also there is no specific format of NOC and it can be drafted if the facts of the matter are produced to any engaged lawyer.

Since the NOC you are talking about is relinquishment of share of property then only a document which is registered one will do or at time of transfer of the same he can join as Confirming Party stating his no objection in transferring his share also.
