Dear Professionals,
Greetings
I have a confusion on some property transfer issue as follow
My father is going to purchase a jointly held house property situate in Odisha, but the problem is both the owner are stay in Raipur and the 1st holder(wife) is not able to come for registration of the transfer for her health problems, but agrees to give POA to her husband (the 2nd holder) to register the same in odisha, so now my question is can she do so...and sir I humbly request to you all professional to guide me regarding the legal issue and solutions to validly transfer the property....In wating of yours valuable advice

any co-owner might give POA but main owner need to be present while registering transfers of property in all normal cases pls

.is the 2nd holder comes in to the ambit of main owner?? cn the poa b registered over there at raipur(other state). the agreement of sales is to b sign before the registarar..(odisha) so that poa can authorise the 2nd holders to validly transfer dt house

She can give POA. Get all the documents scrutinized by your lawyer.

The lady can give a POA - but that POA should very specifically authorise the person to whom she is giving the POA to sell her share in the property. Further, the POA should be registered in the sub-Registrar's office where she is living.
In the recital of the Sale Deed, it should be very clearly mentioned as to who is executing and signing the sale deed for and on behalf of whom.
In any case, please get the sale deed properly drafted through a lawyer in your locality.

yes she can give POA to her husband for execution of registration.... the POA but be a registered and shall mention all points..
