My friend owned a residential house jointly with his wife , in the state of Punjab.Recently he expired leaving his wife , a son and a daughter . He did not make any will.
My understanding is that , being a co-owner surviving spouse , the property devolves on the wife automatically .Is is correct?
If my understanding is correct , what will be the procedure for removing the name of deceased husband from the title deeds ? Please advise.Regards.

Has ur friend nominee as his wife or children. They being legal heirs apply to SOC for transfer. Fill up transfer forms

The property would be inherited by the wife and the share of husband would be inherited by legal heirs of the deceased.

If the property was jointly owned and the co-owner died intestate, his share in the property will not automatically devolve on his wife, it will devolve equally on his wife and children and other legal heirs, if any. Consult a lawyer and proceed further on his advise.

I agree with the advice of expert MR.Kalaiselvan. It isnot that authomatically the wife will become owner of the entire property. In the deceased share, the children also have equal rights along with the mother.
