Traveling abroad while on AB

(Querist) 24 April 2009 This query is : Resolved
Is mandatory to take permission from High court to travel abraod while on Anticipatory bail. The AB was ordered more than 6 months back and the accused have attended enquiry once, which was also 6 monts back.

However, The bail order does not impose that restriction.

Yes it is desirable that you should obtain permission.

It is not necessary if such imposition is not made in the bail order. However as rightly suggested by Mr. Palnitkar if the accused feels that it is better to get permission you can go ahead. Whether to obtain permission or not has to be decided on the basis of the gravity of the offence and charges made and the ground reality.

in my opinion in view of the latest judgments of the SC and the provisions of S. 438 Cr.P.C, permission of the court is necessary while travelling abroad in such a case....genereally such conditions are imposed by the courts, may not be written everytime but are considered to be inherent ones.
