TRUST TO SOCIETY

(Querist) 27 March 2010 This query is : Resolved 
Dear Sir,

I have three questions
1. If there is a trust, can this trust be registered under societies registration act 1860 as a society? if so then how.

2. If a trust has a sole trustee, can he appoint more trustees.

3. If the trust deed needs amendments, how to do that. I mean what is the process.

This trust is in Gujarat.

1,Under Societies Registration Act,and the powers of registration vest in Dy.Charity Commr.of the region.
2.That depends on the mode of succession entered in the PT entry of the Trust.
3.Once the Trust is formed on the basis of the Trust Deed it cannot be amended by the maker of the Deed.But you have to opt for framing Scheme either before the Jt.Charity Commr. or before the District Court.

1. Trust can't be registered under societies registration Act. society needs 7 persons minimum. sole person cant form society

2. appointment of trustees - depends on trust deed.
3. deed amendment to be done with permission of court w.r.t. areas which author meant have come out differently. not for new vistas, objects.

Solution
form a society having similar objectives as that of trust with 7 persons. Let the trust hand over their property to the society
