Two caste certificates from two states

(Querist) 27 March 2013 This query is : Resolved
Hi sir,

A happy holi to all of you!
I am a resident of Delhi by birth and belong to scheduled caste community. My father had made my caste certificate from Delhi about 10 years ago. My distant family lives in Saharanpur UP at my ancestral place. About 2 years ago, my distant uncle from Saharanpur visited my home and asked whether I have caste certificate from UP or not. I told him that I do not have so. He said that everybody is making caste certificate from UP also. He said that he will get them made for me. He took 4 photographs of mine and after about 2 months he returned back with my caste certificate from UP and also Voter-ID though I already had a voter-ID from Delhi. I just kept them and at that point of time I didn't have a faintest idea that keeping two caste certificates and two voter Id is not proper.
Now a few days back, I was going through the Representation of Peoples Act 1951 on internet and learned that section 17 says 'No person to be registered in more than one constituency'. Now, this came as a shock to me. I now figure out from this fact that according to some act and some rules, it would also be improper to keep two caste certificates. However, my caste is same on both certificates and both are recognized scheduled castes in Delhi and UP.

I would also like to state that I have never used and do not intend to use any certificate from UP and Delhi is my only address. On the contrary, I have applied two times in UP PCS in general category and also cleared prelims.

Now, I would kindly like to know from your good selves that have I done any crime? What would happen, in worst case, if I keep them. Can I get my caste certificate and voter ID from UP cancelled? Will it have any repercussions?

Thank You

illegal action is illegal and can call repercussion at any time.

Sir but what should I do now ? I never applied for caste certificate from UP. Neither I nor my father nor any close relative applied for that by signing it. The system in UP is so much distorted that through touts anybody can get it made.
This fear of unknown doesn't help me. What should I do now?

It is illegal and crime. Try to. Surender one and cancell. Approach local authority

try to discuss with the officials and tell unknowingly it was issued and surrender there wont be any problem if you surrender and take acknowledgement
Jolly Kumar (Querist) 27 March 2013
Will surrendering it before local SDM call for a police enquiry ? I also fear that by initiating for 'surrender' maybe I am creating a problem for myself. And what about second voter-ID? I don't know why he got it made and created this problem for me. I just want to get rid of it. I have never used this certificate despite the fact that since last two years of its possession, I have applied about three times in UP PCS and always only in general category as applicable to all outsiders.

no need of worry, because you are not mis used it in any point.
Jolly Kumar (Querist) 27 March 2013
Yes Sir, I have not used the UP caste certificate in any way. I consider myself in general category in UP. But my name has to be struck off from UP election roll. Right? That was put there without my permission by my distant uncle. Maybe he got voter card made as a prerequisite for caste certificate.
Jolly Kumar (Querist) 28 March 2013
As I was discussing it with my family last night, my father called my distant uncle in village to get my name removed from the electoral roll. Now, will it work fine if he approaches authority and get my name struck off or my going in person will have more gravity ?

If your name gets strucked off from the roll of UP and the certificate issued thereon also gets cancelled, you shall not face any problem in future.

He possesses it because his uncle in relation got it prepared but the author had also given his acceptance to get it prepared when he handed over him his 4 photos.

certificate cannot be issued until and unless he applies to the same and the claim is verified by Patwari. It is he who has applied for the same and is not coming clear with the facts.
Jolly Kumar (Querist) 13 June 2013
Sir, I have presented all the facts before you. Why would I hide from you? If I do then what good your advice will be for me? I NEVER applied for any caste certificate, NEVER signed and if somebody else might have signed on behalf of me, then it is unknown to me and a fraud. I don't even know the working of SDM office or patwari. Even I never wanted any caste certificate. I want to do my own business. That is why I want to get rid of these unwarranted documents.
