ajay sethi (Expert) 15 December 2013
merely because you filed divorce case doeas not mean that case of Dv filed by wife will come to an end . these are separte proceedings
T. Kalaiselvan, Advocate (Expert) 15 December 2013
Divorce case is a separate question of law differing totally to the issues of Domestic violence related issues, only relevance matter can be discussed during trial of the either case with relation to each other, but there is no provision in law that since this is there, so that cannot co-exist hence may be thrown out etc., even if she files a complaint u/s 498a and dowry prohibition act, they too will be maintainable for trial simultaneously.
Rajendra K Goyal (Expert) 15 December 2013
Both are separate cases. No such provision exist.
Nadeem Qureshi (Expert) 16 December 2013
if you think that DV case is false and filed by the wife after one year of seperation then you can go for quashing before hc under section 482 of crpc. apart from this there is no provision to stop the proceeding.
Raj Kumar Makkad (Expert) 16 December 2013
Defend DV case and get it dismissed is the only solution.
Dr J C Vashista (Expert) 18 December 2013
Engage a local lawyer, contest the case and prove it to be false, then file (civil or criminal)defamation, as advised.
