(Querist) 22 November 2013 This query is : Resolved 
Accused acquitted in complaint u/s 138 NI Act & complainant filed appeal against acquittal in Session Court without taking special leave from High Court.Can this appeal is maintainable or not as u/s 378 (4) of CrPc laid provision regarding this for complaint case.

If sessions court has taken the appeal on file, whether disposed? or rejected the appeal?, I have filed an appeal myself before the sessions judge on the same lines and the trial is going on; there is no murmur about its maintainability so far.
