Raj Kumar Makkad (Expert) 01 April 2010
In case ESI is applicable then 1/2 and otherwise full wages are to be paid.
Parthasarathi Loganathan (Expert) 02 April 2010
But injury should not have resulted due to negligence or violation of safety measures by the worker/ This condition must be satisfied.
H. S. Thukral (Expert) 02 April 2010
If ESI is not applicable, the workman is entitiled to half month wages (25 % payable after every 15 days) under workmen's Compensation Act. This applies to all employees whether they are covered under the ESI Act or not.
