Want to file a fraud case

my friend took rs 1,00000 from me for his study and assured me to return my money as soon as possible. but recently he is not picking up my phone and reply to my mail. i want to file a case against him. but i had transfered the money from my hyderabad account to kerala account and now he has left kerala and lives in orissa. so please kindly suggest me in which place i can file a case against him and is it possible to file a case at orissa.

first you send the legal notice about the return of the money, and collect the evidence and proof.

As this was a personal loan so place of sue is not so important. You have not mentioned what evidence you have in your hand necessary to file the desired suit.

Then you can sue from 'Hyderabad'as money moved from your a/c from here. 'Kerala' also has jurisdiction but it would be inconvenient to you also as you are in 'Hyderabad'and he has also left 'Kerala'

The other jurisdiction may be place of negotiation.

i had transfered the money through internent banking.so his bank account is added in my third part list and in my internent banking i have proof about the money which i transfered to his bank account.

This is not a fraud case. However, it will be better for you to trace the whereabouts of your friend and send him a notice for repayment back to you within a sopecified time and only after getting response or no response, you should decide to file any case for recovery or attachment of his properties, if any.
