Dear All,
I have few question.
1) what is the base of calculation of wc compensation.whether it icludes Basic component and other allowances or Basic only. whether max.wages should be consider Rs.8000/- or the person is drawing more than Rs.8000/- pm as wages shall be considered.
2) While coming on duty if an employee met with an accident can be covered under the act.he was coming on duty by his own vehicle.
while coming in company one employee met with an accident,but insurance compant repudiated the calim since employee was not coming thr.employer vehicle.please can you confirm to get claim travelling thr. employer vehicle is condition or it is law.

Dear Sir,
I am working in HR this issue happened with one of our employee,he was coming to company and while coming on duty met with an accident.it was minor injury -Temperory Disablement but it took a 15 days to recover,so we have send the Medical papers with loss pay record to get compensation from insurance company,but they denied it on the basis that employee was travelling by his own vehicle.it was not company provided Bus/ Vehicle and they repudiate the claim.

terms of Insurance policy need to be referred.

If claim rejected wrongfully, move to consumer forum.
