Yesterday I filed an emergent petition for appointment of commission in an Injunction suit and I prayed for the inspection of Plaint Schedule Property to be taken in Video. My prayer video is turn down by the court. Could any body show me any citation to enlighten the Munsiff.

Normally advocate commissioner has inherent power to vediograph the suit properties in dispute, without separate Orders. It is common that such vedio CDs are submitted before the Court along with the Commissioners report. If the prayer for enabling the advocate commissioner to take vedio is turned down by the court, then you can take such vedio at your own if access to the disputed property is available and submit the vedio CD to the court through your advocate evidencing your position.

Thanks Raju.I fully agree that there is no need for separate orders from the court for taking video of the suit property. Unfortunately some Judicial officers are lacking minimum common sense.
