This query is : Resolved
sir kindly explain me below
(1) when a reserved category candidate e.g a sc candidate secures more marks than the cut off marks fixed for general category then is it compulsory for the commission conducting exam that such reserved category candidate be placed in general list?
(2) if ans to my above ques is yes then if such reserved candidate has availed age relaxation i.e (upper age limit for sc candidate is not exceeding 35 yr)then such a reserved category candidate is to be placed in general merit list or not ??
(3) if the last 4 general category candidates are securing 150 marks in any given examination for final selection(written test followed by interview) and if there is a reserved category candidate available who also secured 150 marks but not taken in general list then IS THERE ANY RULE THAT why such 150 marks securing candidate is not taken in general list.
moreover the name of such reserved category candidate is placed above those 4 general category candidates in overall merit list..
such unreserved candidate even did not avail age relaxation i.e he being 29 and less 30 has passed exam..
my general plea is that what are the rules for placing reserved categry candidates in general merit list untill all vacancies for general categories are filled...
thanks to learned advocates

Dear Kuldeep,
Merit in selection and roster for general & reserved category candidates (with age concession) are two different things.
While merit is worked out on the basis of scores obtained by the candidates, irrespective of the fact to which category the candidate belongs, the roaster is maintained as per the reservation points as per the reservation policy.
Merit decides the inter-se seniority, where roaster makes clear whether the points or reservation are filled as per the prorata No. of posts reserved for the candidates of reserved category or not, and no point is left blank by short selection of that category of candidates, except when candidates are not able to secure the prescribed qualifying marks.
However, any meritorious candidate from the reserved class, irrespective of adjustment against which point in the roaster, can not be downgraded in seniority merely because he belongs to the reserved category and has availed age concesssion. But, ratio between the general & reserved category candidates has to be maintained, as per the reservation policy. Similarly, if other reserved candidates obtain merit lower than the general candidates, they have to be kept below the general candidates in merit, irrespective of whether against which points of reservation they get adjusted amongst the general candidates in the roaster.

and sir if for any given job there exist a reserve panel i.e in case there exist any vacancy e.g some candidate not joined...then can candidates put in reserve panel be taken up later to fill up those posts...and if such qualified candidates have once got seated up on those posts and thereafter vacates such posts then i want to know whether reserve panel still have some meaning...i.e posts once filled up can be further given to reserved panellled candidates...
provision for a reserve panel as to me is to fill gaps occuring in seats..
all in all if seats are once filled up ...can reserve panel be taken up agaist those posts...
a big thanks in anticipation

Dear Kuldeep,
Ifs & buts denote only presumptions. You will have to discuss the real problem, if there exists any. Otherwise, continuing discussion on academic queries will be a sheer waste of time by you and all the experts trying to respond to your query.
I have given you enough input on your basic discription of the problem. Being an advocate, yourself, you should have taken hint to proceed further, if you have encountered some real problem pertaining to a case of any of your client. So, I advise you to read the reservation policy of Government of India and states, which is voluminous and cannot be discussed in just a few lines. But, if you want further assistant from my side, you will be welcome to send me the detail of the problem through email at dcgroup1962@gmail.com, but subject to payment of my professional fee.
