Wife falsely framed me and my family member u/s 354/323/324/506/509

Hi All,

There has been matrimonial dispute going on b/w me and my wife.in this regard my wife complaint to CAW kriti nagar. it has been since march counsling going on but 9th april when i went to CAW Cell and was returning after counseling my father -in law starting abusing me and tried to fight with me somehow i manage to go kriti nagar police station as both caw and police building are joint but my father -in law and wife also came there and tried to fight with me. the sho of kirit nagar at the spot he asked both parties to go outside of police station as your matter already going on CAW. As i went outside both baap aur beti again fight with me and they made a PCR 100 no call immediately i ran toward Police station to avoid the fight the police made a one side case 107/151 this incident happen on 9th April 2015.and after that incident i start going on caw cell with my mother and on Friday17th july 15 i came to know that my wife filled a false complaint of 9th april incident and police lodge a Fir u/s 354/323/324/506/509 cases against me and my father and uncle and one more person also we are getting call from DWARKA SEC-9 SHO and he is asking us to come to PS and i v had word with him as per him your wife alleged sexual harrasment and i am thinking DW PS sec-9 will book under same cases like 354 against all my family member.

i am very afraid and i dont know what to do and how to save my self and my family member against these false cases please advice.

Dear Mr. Neeraj Yadav,

1. Since you have had mentioned your mobile number so i thought it fit to talk to and in response you did call me back and we have discussed the facts of the situation and i have advised you as what best you should do. Meet the SHO of Dwarka and brief him about the incident that took place at kirtinagar caw cell on 9th April '15 and the history of the complaint before the caw and mention that case of 107/151 in which you were the only accused cited as the accused and the M.L.C. certificate does not show any grievous injury and that you were released on bail by the Executive Magistrate after signing the good conduct bond. Request the S.H.O. to give a notice u/s 41-A Of Cr.P.C.to you all and so the S.H.O. will not arrest you.If the S.H.O. says that he has to arrest you all then seek time from him to get anticipatory bail from the Sessions Court or the H.C. Engage a good local lawyer and proceed for Anticipatory bail. If police is not lodging your case / FIR against them file direct complaint to the magistrate.

Hi All ,

Thanks for your suggestion and reply . i've contacted to local lawyer and he is going to apply for bail in session court .Further my wife also Reported to National women commission delhi and we have got summoned to appear for same. but i want to make sure my wife didn't take advantage of this interaction like she did earlier on kirti nagar women cell date and lodge a false complaint/Fir against us . To avoid this can i ask national women commission to provide separate date to us and my in-laws so that we can avoid any posiblity of conflict and false allegation.
