writ Petition/PIL

(Querist) 21 May 2011 This query is : Resolved
Respected Sir/Madam,

I wanted to know, that when a person files a PIL, does he / she necessarily need to engage an advocate and is the person so aggrieved, eligible to represent himself in the Court?

The case I refer to here is regards delay of 6 months in conduction of examinations and therefore there will be delay of academic session...resulting in loss of 1 complete academic year...

What remedy is available?
At the prliminary stage, before opting to file a PIL, should I write an application to the Vice-Chancellor, and a copy of the same to HOD, Dean, Examination Incharge and Registrar..?

No. Its no need to be sent notice to the respondents before filing writ petition in all cases. Its depends upon the case, and its urgency..

And, the aggrieved person can be prosecute his case as IN PERSON. But its better to appoint an advocate for your case. Its will be very helpful for conversate with justices without court fear, and face the other side advocate's tactics..

Greetings,
It is always better to present a representation to the proper authorities before ligating as the court sometimes question whether you have brought the grievance to the knowledge of the authorities concerned.
And you can appear as a party in person. But is always a better to let the professional do the job.

Sure, you can write first to the Vice-Chancellor, and a copy of the same to HOD, Dean, Examination Incharge and Registrar to make your case solid if you don't get any positive reply in reasonable time.

I sincerely thank everyone for their valuable advice. accordingly, i have written an application adressed to the vice chancellor and a copy of the same to other authorities.

Sir,

I would also want to know whether or not it will be appropriate if I make a demand that my requests be coomplied with within a couple of days since we have already been delayed by 6 months...and any inaction or slack attitude will only result in further delay.

In my case, i intend to request the declaration of examination dates of the current session which is running awfully late, as well for the next session to prevent any similar such uunexplained and unnecessary delay.

once again I thank all the Experts who have taken time off their busy schedules to answer my queries......THANKYOU ALL.

Regards,
student.
